President Bush recently signed a pro-business bankruptcy reform law that could cause the biggest change in bankruptcy law since 1978. Under the new law, those who want to file for Chapter 7 bankruptcy but have an above-average income, could be forced to pay certain debts over time instead of having them completely discharged. The proposed law expands the list of debts can never be wiped out in bankruptcy.

On April 4, 2005, the U.S. Supreme Court ruled that tax-deffered Individual Retirement Accounts are exempt from creditors under federal bankruptcy law. Social Security benefits, company pensions, 401(k) plans and other benefits tied to age, illness or disability have previously been declared exempt. This means that you can retain these key assets if you declare bankruptcy.
